This Acceptable Use Policy (“AUP”) describes prohibited and restricted uses of Terraflare.ai’s AI-powered advertising platform, APIs, and related services (“Services”), provided by Shenzhen Yantu Technology Co., Ltd. (“Terraflare”, “we”, “our”, or “us”).
This AUP is incorporated into the Terraflare Terms of Service. By using our Services, you (“Customer”, “you”) agree to comply with this AUP.
1. Content Restrictions
You may not upload, store, post, or transmit any content through the Services that:
- Is obscene, defamatory, harassing, threatening, hateful, discriminatory, or violates public order and morals (e.g., pornography, violence, or extremist material).
- Infringes on intellectual property rights (e.g., copyrights, trademarks), privacy rights, publicity rights, or other legal rights of any person or entity.
- Violates applicable laws, regulations, or advertising platform policies (e.g., Amazon Ads, Google Ads), including but not limited to false advertising, illegal product promotions, or deceptive marketing.
- Contains viruses, worms, malware, malicious code, or other harmful components that could damage or disrupt the Services or third-party systems.
- Promotes illegal, fraudulent, or deceptive products or services (e.g., counterfeit goods, unlicensed pharmaceuticals, investment scams).
🔍 Examples of prohibited content: Fake medical advertisements, fake reviews, hate speech targeting specific groups, or content that incites violence.
2. Prohibited Conduct
You agree not to:
- Engage in fraudulent, misleading, or illegal activities, including but not limited to spoofing (forging identities), phishing (stealing sensitive information), or click fraud (artificially inflating ad clicks).
- Use the Services to transmit spam (unsolicited bulk messages), bulk marketing emails, or unsolicited communications (e.g., cold calls/emails without consent).
- Publish, benchmark, or disclose Service performance results (e.g., ad metrics, ROI data) without our prior written consent.
- Interfere with or disrupt the integrity, availability, or performance of the Services (e.g., overloading servers with excessive requests).
- Attempt unauthorized access to accounts, systems, or networks related to the Services (e.g., hacking, brute-force attacks).
- Circumvent or manipulate ad platform rules (e.g., Amazon Ads review policies, Google Ads quality guidelines).
- Use AI-generated outputs to mislead consumers, falsify reports, or engage in deceptive advertising practices (e.g., generating fake testimonials).
🔒 Note: “Spoofing” refers to forging identities or information (e.g., pretending to be a trusted brand); “Phishing” refers to fraudulently obtaining sensitive data (e.g., passwords or payment details).
3. No Security Violations
You may not:
- Probe, scan, or test the vulnerability of any Terraflare system or network without authorization (e.g., attempting to find security flaws).
- Breach or attempt to bypass security or authentication measures (e.g., stealing login credentials or exploiting weaknesses).
- Perform denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks (e.g., flooding servers with traffic to disrupt service).
- Access or attempt to access accounts, data, or systems that do not belong to you (e.g., using others’ credentials).
⚠️ Exception: Legitimate security testing (e.g., penetration testing) requires prior written approval from Terraflare.
4. Fair Use of Services
To maintain service stability and ensure fair access for all users, you may not:
- Exceed reasonable usage limits of APIs, queries, or reports without prior authorization (e.g., single-day API calls exceeding 100,000 or per-IP requests over 50/second; actual limits subject to official notices).
- Automate excessive requests that could degrade Service performance (e.g., bots or scripts causing server overload).
- Resell, sublicense, or make the Services available to unauthorized third parties (e.g., sharing login credentials or reselling API access).
📌 Note: Specific usage limits will be communicated via the Terraflare dashboard or official notifications.
5. Restricted Business Activities
You may not use the Services to promote, advertise, or support the following:
- Illegal drugs, controlled substances, or unlicensed medical/healthcare products (e.g., prescription drugs without approval).
- Weapons, explosives, or materials related to violent activities (e.g., firearms, ammunition, or self-defense tools banned by law).
- Gambling (e.g., online casinos, sports betting), adult content (e.g., pornography), or escort services.
- Misinfolmation (e.g., fake news), deepfakes (synthetic media used to deceive), or harmful AI-generated content (e.g., content inciting hatred or discrimination).
- Activities that violate advertising laws, consumer protection regulations, or international trade sanctions (e.g., promoting sanctioned goods or services).
📢 Example: Using Terraflare to generate ads for unapproved medical devices or to spread false claims about a product’s efficacy is strictly prohibited.
6. Enforcement & Monitoring
- We may monitor Service usage (e.g., API calls, account activity, content uploads) to ensure compliance with this AUP.
- We may investigate suspected violations and suspend or terminate your account at our sole discretion, with or without prior notice.
- We may report suspected illegal activity (e.g., fraud, child exploitation) to law enforcement or regulatory authorities in accordance with applicable laws.
- We reserve the right to remove or block any content that violates this AUP, including AI-generated outputs or uploaded materials.
🛡️ Note: Monitoring is conducted solely to protect service integrity and user safety, and we will handle your data in compliance with the Terraflare Privacy Policy.
7. User Reporting & Feedback
- You may report suspected violations of this AUP by contacting us at: [email protected] (24-hour response commitment for urgent cases) or via the in-app reporting channel (Path: Settings → Help → Report Violation).
- We will review reported content/actions promptly and take appropriate measures (e.g., warning, suspension, or termination). Your identity will be kept confidential unless required by law.
8. Updates
- We may revise this AUP from time to time to reflect changes in laws, advertising platform rules, or service features. The latest version will be posted on our website (https://terraflare.ai/aup).
- If we make material changes, we will notify you via email or through the Terraflare dashboard at least 7 days prior to the changes taking effect.
9. Governing Law & Dispute Resolution
- This AUP is governed by the laws of the People’s Republic of China, without regard to conflict of law principles.
- If you have any disputes regarding this AUP, you may first contact us at [email protected] for resolution.
- If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration in Shenzhen, China, administered by the Shenzhen Court of International Arbitration (SCIA) or China International Economic and Trade Arbitration Commission (CIETAC) under their then-effective rules. The arbitration award shall be final and binding.
⚠️ Users outside of China agree that this AUP does not violate the mandatory laws of your jurisdiction, and you may seek remedies under local law where permitted.
